China
has introduced new nationwide filing requirements for institutions
and personnel engaged in entry-exit intermediary services, with the
new rules taking effect on September 15,
2026.我国正式出台全国出入境中介机构及从业人员备案管理规定，新规将于

On
September 14, the National Immigration Administration (NIA) and the
State Administration for Market Regulation jointly issued the
Measures for the Filing and Administration of Institutions and
Personnel Engaged in Entry-Exit Intermediary Services (the
“Measures”).9 月

日，国家移民管理局、市场监管总局联合发布《从事出入境中介服务机构和人员备案管理办法》（以下简称《办法》）。

Formulated
in accordance with the Exit and Entry Administration Law of the
People’s Republic of China and the Regulations on the
Administration of Entry and Exit, the Measures aim to standardize the
filing and administration of institutions and personnel engaged in
entry-exit intermediary
services.《办法》依据《中华人民共和国出境入境管理法》《出入境管理条例》制定，旨在规范出入境中介服务机构与从业人员备案管理工作。

The
Measures contain 14 articles and further clarify requirements
concerning the scope of filing, filing deadlines and filing
materials. They also establish that exit-entry administration
departments of public security organs under local governments at the
county level or above will be responsible for filing management of
institutions and personnel engaged in entry-exit intermediary
services within their respective jurisdictions.《办法》全文共
14
条，进一步明确备案范围、备案时限、备案材料等要求；县级以上地方人民政府公安机关出入境管理部门，负责本辖区出入境中介机构及人员备案管理。

While
strengthening supervision and administration, these departments are
also required to continue improving procedures and make the filing
process more convenient for institutions providing such
services.监管在强化的同时，相关部门持续优化办事流程，提升中介机构备案便利度。

The
NIA is also expected to establish a national unified public
information platform for filing records on its official website,
where information on institutions and personnel that have completed
filing will be published in a timely
manner.国家移民管理局将搭建全国统一备案信息公示平台，在官网及时对外公示已完成备案的机构、人员信息。

01什么是出入境中介服务｜Definition
of Intermediary Services

Entry-exit
intermediary services refer to activities in which institutions
accept the entrustment of people entering or leaving China and
provide intermediary services for activities such as tourism,
business, study, employment and settlement, including consultations
on entry-exit policies, document applications and procedure handling,
and charge relevant fees as
agreed.出入境中介服务：机构接受出入境人员委托，为旅游、商务、留学、就业、定居等事项提供出入境政策咨询、文书代办、手续办理等中介服务，并按约定收取费用。

02备案主体与时限｜Filing
Subjects & Deadlines

Institutions
engaged in entry-exit intermediary services shall complete filing
with the exit-entry administration department of the public security
organ of the local people’s government at or above the county
level where the institution is
located.从事出入境中介业务的机构，需要到机构所在地县级以上公安出入境部门办理备案。

Where
branches are established across different regions, each branch shall
separately complete filing.跨区域设立分支机构的，每一家分支机构需要单独备案。

The
legal representative or person in charge, management personnel and
employees who directly provide intermediary services shall be filed
by the company.法定代表人、负责人、管理人员、直接提供中介服务的员工，统一由所属机构代为办理人员备案。

✅ 新设立机构：成立起15日内完成备案Newly-founded
institutions: File within 15 days after establishment.

✅ 存量中介机构：《条例》实施起90日内完成备案Existing
intermediaries: Complete filing within 90 days after regulation
implementation.

✅ 原有机构新增该业务：开展业务起15日内备案Existing
companies adding this business: File within 15 days after starting
service.

Institutions
shall guarantee all filing materials are true, legal and valid.
Submitting false information will bear corresponding legal
liabilities.机构提交备案材料须保证真实、合法、有效；提交虚假资料，需承担相应法律责任。

04备案变更与注销｜Filing
Change & Cancellation

If
registered information changes (company name, address, staff,
business scope, overseas partners, website & social accounts
etc.), the institution shall apply for change filing within 15
days.备案信息发生变更（机构名称、经营地址、备案人员、经营范围、境外合作方、联系方式、网站及社交账号等），需在变更后
15
日内办理变更备案。

The
filing shall be cancelled and filing certificate returned in the
following situations:出现以下情形，应当主动办理备案注销并交回备案凭证：

Stop
providing entry-exit intermediary services voluntarily

自愿不再从事出入境中介业务

Dissolution,
bankruptcy or other statutory termination

解散、破产、法定终止经营

Business
license or relevant permit revoked

营业执照、相关业务许可被吊销

05监管与合规义务｜Supervision
& Compliance Obligations

Exit-entry
authorities will conduct regular inspection and random sampling, and
accept complaints and reports.出入境主管部门采取日常检查、随机抽查、投诉举报核查方式开展监管。

Joint
supervision mechanism with market regulation departments will be
established. Violations and bad records will be disclosed to
public.会同市场监管等部门建立联合监管机制，违法违规、不良记录依法对外公示。

Institutions
must keep service contracts, user files, financial documents properly
and cooperate with
inspections.中介机构需规范服务流程，建立客户档案，妥善保管合同、个人资料、财务凭证，配合监管核查。

Institutions
and personnel in breach of rules will face administrative penalties.
Where the act constitutes a crime, criminal liability will be
pursued.机构、人员违反备案管理要求或业务义务，将依法予以行政处罚；涉嫌犯罪的，追究刑事责任。

06实施时间｜Effective
Date

These
Measures shall take effect on September 15, 2026.本《办法》自
